Outdoor Burning

NOTICE: As of October 28, 2011, the countywide outdoor burn ban, in effect since July 1, 2011, has been rescinded. A permit is required before any outdoor burning is allowed. Please review the rules and procedures to follow to apply for an outdoor burn permit.

Rules

  1. ONLY dry plant growth natural to the burn site can be burned.
  2. No permits will be issued inside of a city limits.
  3. A burn permit must be obtained by submitting a burn permit application to the Collin County Fire Marshal’s Office.
  4. Opening burning is NOT permitted on  lots where there is less than 50 feet of clearance from a structure and 50 feet from other combustible material, i.e., trees, bushes, power lines, etc.
  5. There must be a 50 foot fire break around the material to be burned.
  6. The burn pile shall be no larger than 10 feet in diameter and 5 feet in height.
  7. A competent person shall continuously attend the burn pile until the fire is extinguished.  This person shall have a water supply or other fire extinguishing equipment readily available for use.
  8. Hours of burning shall be confined to one hour after sunrise and one hour prior to sunset. ALL FIRES* SHALL BE EXTINGUISHED BEFORE SUNSET.  
    *A FIRE IS ANY AMOUNT OF HEAT WHICH CAN PRODUCE SMOKE OR FLAME.
  9. Hauling of materials, brush or vegetation, onto the site from another property will render this permit invalid.
  10. The Fire Marshal and/or local responding emergency services official is authorized to require that open burning be immediately discontinued if it is determined that smoke emissions are offensive to occupants of surrounding property or if the open burning is determined to constitute a hazardous condition.
  11. NO Burn Days are determined as follows:
    • Wind is or expected to be below 6 mph or above 20 mph
    • Ozone Action Day has been issued for the DFW area
    • If Collin County enacts a “Burn Ban” on all outdoor burning

Burn Permit Application
Burn Permit Fees:
Residental outdoor burning $ 30.00
Commerical < 20 acres $250.00 per project
Commercial > 20 acres $500.00 per project

Residential Burn Permits expire 90 days from the date issued.  Upon written request the permit may be granted a 90 day extension.  The written request must be received by this office 10 business days prior to the expiration date.  Commercial burn permits expire 7 days from the date issued, no extension allowed.

Authorization to conduct outdoor burning does not exempt or excuse a person from the responsibility, consequences, damages, or injuries resulting from the authorized burning and does not excuse a person from complying with other applicable laws, ordinances or regulations.
